一、內(nèi)容和范圍

二、質(zhì)量體系審核和產(chǎn)品抽樣檢驗

1.正式質(zhì)量體系審核時間擬定在______年______月份進行，最終商定的審核時間，其偏離度不能超過一個月。(甲方如需預(yù)審核，希望審核時間在______年______月______日，預(yù)審核時間至少比正式審核時間提前一個月。)

1.乙方按中國節(jié)能產(chǎn)品認證管理委員會發(fā)布的《認證收費管理辦法》，對甲方在本合同有效期限內(nèi)的認證申請(包括擴大型號規(guī)格的認證申請)，按下列收費標準收取相關(guān)階段某證費用，收費時，向甲方發(fā)出正式的《認證收費通知書》，甲方應(yīng)按《認證收費通知書》的要求及時向乙方繳納認證費用。

2.收費標準：

審核/抽樣人員執(zhí)行審核/抽樣任務(wù)所發(fā)生的差旅費，食宿費按實際支出由甲方支付。

四、甲方的責(zé)任和義務(wù)

1.在產(chǎn)品認證實施某段某按認證活動進展情況或乙方通知，向乙方提交有關(guān)文件和資料或進行必要的工作。

2.在實施某認證時，應(yīng)提供至少三個月的質(zhì)量體系運行的有效證據(jù)。

3.認證活動開始前，應(yīng)向乙方明確甲方的保密要求和特殊要求。

4.應(yīng)向乙方無償提供抽樣檢驗的樣品，負責(zé)把抽取的樣品按乙方規(guī)定的時間，運送到指定的檢驗機構(gòu)。甲方保留回收抽檢產(chǎn)品的權(quán)利。

5.向乙方在甲方現(xiàn)場執(zhí)行認證任務(wù)的人員免費提供通訊設(shè)施某通工具，辦公設(shè)施某絡(luò)向?qū)Ъ捌渌匾Y源。

6.應(yīng)按期向乙方及檢驗機構(gòu)交付各項認證費用。

7.除本合同規(guī)定的條款外，甲方不應(yīng)再以任何方式或名義向?qū)徍?抽樣/檢驗人員饋贈錢，物(包括紀念品，加班費，勞務(wù)費等)。一旦發(fā)現(xiàn)，乙方將終止認證活動并視認證結(jié)果無效。

8.應(yīng)按《認證證書和標志使用管理辦法》的有關(guān)規(guī)定，正確使用認證證書和認證標志。

9.當(dāng)質(zhì)量體系發(fā)生變更(如法定代表人，組織名稱，地點變更及《質(zhì)量手冊》更改等)，認證證書所涉及內(nèi)容變更，以及發(fā)生重大質(zhì)量問題和顧客重大投訴時，應(yīng)及時通報乙方。

10.甲方應(yīng)確保獲證產(chǎn)品在認證證書有效期內(nèi)，該型號規(guī)格產(chǎn)品始終保持產(chǎn)品性能并符合認證要求。其使用的關(guān)鍵零部件和材料應(yīng)與乙方最終確認的《受控部件/材料備案清單》保持一致，如需變更，應(yīng)及時向乙方提出申報，經(jīng)認可后，方可變更使用。未提出認可申請或經(jīng)檢驗評定未通過認可時，獲證產(chǎn)品不得使用變更的受控部件和材料。一經(jīng)發(fā)現(xiàn)，乙方將對該產(chǎn)品認證證書做出暫停直至撤銷的決定，并同進停止使用認證標志。

11.甲方因故被暫?；虺蜂N認證注冊資格時，應(yīng)暫?；蛲Ｖ故褂谜J證證書和認證標志，并向乙方交回全部認證文件。

12.隨時接受中國認證機構(gòu)國家認可委員會(cnab)對甲方的臨時調(diào)查。

五、乙方的責(zé)任和義務(wù)

5.1格履行國家產(chǎn)品質(zhì)量認證方面的法規(guī)和國際準則。

5.2 按照標準和有關(guān)程序，客觀，公正地為甲方提供產(chǎn)品認證服務(wù)。

5.3在收到甲方交付的費用后，及時組織實施某的產(chǎn)品認證活動。

5.4乙方的審核組成員應(yīng)按有關(guān)規(guī)定配備，并征得甲方同意。

5.5乙方應(yīng)公正，科學(xué)，客觀，實事求是地提出問題和處理問題。

六、風(fēng)險

1.甲方建立的質(zhì)量體系如達不到/不能保持達到 ccc/t032002的有關(guān)要求，或產(chǎn)品質(zhì)量不能保持達到規(guī)定要求，將承擔(dān)不能取得或被撤銷認證注冊資格的風(fēng)險。

2.乙方要承擔(dān)因甲方獲證后質(zhì)量體系失效，產(chǎn)品質(zhì)量/性能指標下降而引起甲方的顧客不滿意被投訴，損害聲譽乃至被認可機構(gòu)暫停，撤銷產(chǎn)品認證，注冊資格的風(fēng)險。

七、保密原則

乙方應(yīng)保守甲方技術(shù)，經(jīng)營和管理秘密，未經(jīng)甲方書面許可，不得以任何方式泄露給第三方，但下列情況除外：

a.甲方及其關(guān)聯(lián)公司范圍外已公開的文件和資料，但不包括第三方侵權(quán)所獲的文件和資料;

b.法律另有要求時;

c.國家主管部門要求時。

注：國家主管部門指國家經(jīng)濟貿(mào)易委員會，國家質(zhì)量監(jiān)督檢驗檢疫總局，國家認證認可監(jiān)督管理委員會和中國質(zhì)量認證機構(gòu)國家認可委員會。

八、爭議處理

在合同履行過程中發(fā)生爭議，雙方應(yīng)當(dāng)協(xié)商解決，如不能達成協(xié)議，可以：

a.申請中國節(jié)能產(chǎn)品認證管理委員會(ccc)仲裁;

b.申請中國認證機構(gòu)國家認可委員會(cnab)仲裁;

c.按司法程序解決。

九、違約處理

甲方或乙方因各自的原因不能在合同規(guī)定的期限內(nèi)如期進行產(chǎn)品認證，責(zé)任方應(yīng)向?qū)Ψ街Ц断喈?dāng)于某同規(guī)定認證審核費用的5%作為違約金。

甲方或乙方如有違犯合同行為，使另一方遭受損失，則受損失方可要求賠償損失，但賠償金額最多不超過本合同規(guī)定的認證審核費用。

一、適用范圍

二、雙方責(zé)任

2.1乙方責(zé)任：

對甲方提交的并經(jīng)雙方確定的認證范圍的消防產(chǎn)品實施產(chǎn)品質(zhì)量認證，應(yīng)按有關(guān)規(guī)定配備現(xiàn)場審查組，審查組成員應(yīng)得到甲方同意。審查和抽封樣品應(yīng)保證公正、客觀、科學(xué)地實施，審查的過程和結(jié)果滿足cccf認證要求后，頒發(fā)產(chǎn)品認證證書和申購認證標志證明文件。

2.2甲方責(zé)任：

向乙方提供認證所需要的全部資料，為乙方提供必要的工作條件，并積極配合認證工作，保證其順利進行。提供質(zhì)量手冊，申請書及附件和至少三個月的質(zhì)量管理體系運行的有效證據(jù)。按時向乙方交付規(guī)定的費用。遵守cccf有關(guān)認證證書保持，暫停、撤消和注冊的要求，在證書有效期內(nèi)，甲方質(zhì)量管理體系，產(chǎn)品變化時應(yīng)及時通知乙方，遵守有關(guān)認證標志使用的要求，接受乙方按國家有關(guān)規(guī)定進行的監(jiān)督審查。

2.3乙方對甲方的保密承諾：

乙方不得將甲方經(jīng)營，生產(chǎn)狀況及技術(shù)資料以任何方式泄露給第三方，但以下情況除外：

2.3.1應(yīng)甲方要求公開的信息;

2.3.2甲方在本單位范圍外已公開的資料;

2.3.3法律另有要求時;

2.3.4國家主管?部門要求時。

三、風(fēng)險

3.1甲方建立的質(zhì)量管理體系和產(chǎn)品質(zhì)量如達不到或不能保持達到標準要求和乙方的規(guī)定要求，將承擔(dān)不能取得證書或被撤消認證資格的風(fēng)險。

3.2因甲方獲證后不按認證審查過程的質(zhì)量管理體系運行，產(chǎn)品質(zhì)量下降，發(fā)生質(zhì)量事故等造成產(chǎn)品不合格而引起被顧客投訴或產(chǎn)品質(zhì)量監(jiān)督部門查處，乙方不承擔(dān)任何責(zé)任。

3.3對認證過程中或監(jiān)督審查中甲方因乙方責(zé)任的任何損失，其索賠的賠償費將不得超過甲方的認證審查費或本次監(jiān)督審查費;乙方將不承擔(dān)隨后的任何損失賠償。

四、審查時間

六、爭議處理
